Al-Dameer: Three Years of Crimes and Violations Expose the International Communitys and International Justice Systems Failure and Inaction to Protect Civilians and Hold Perpetrators Accountable

Al-Dameer Association for Human Rights – Gaza states that today, 7 October 2026, marks three years since the beginning of the genocide in the Gaza Strip, during which some of the gravest and most horrific crimes and violations of the modern era have been committed. These crimes have resulted in tens of thousands of Palestinians being killed and injured, widespread destruction of homes, health, educational and religious facilities, and civilian infrastructure, as well as mass displacement and a severe deterioration in the humanitarian and living conditions of the civilian population, amid shameful international silence and continued failure to hold perpetrators accountable.

According to information available to Al-Dameer Association for Human Rights, the number of Palestinian fatalities who have reached hospitals in the Gaza Strip since the beginning of the aggression up to 7 October 2026 has reached 74,243, while the number of wounded and injured has reached 175,232. Additional victims remain trapped under the rubble and cannot be reached due to the scale of destruction and the shortage of equipment, fuel, and resources required for rescue and recovery operations.

Since the announcement of the ceasefire on 11 October 2025, the suffering of civilians has not ceased. According to the Ministry of Health, 1,462 Palestinians have been killed and 5,151 injured, in addition to the recovery of the bodies of 836 Palestinians killed during the period following the ceasefire.

Approximately 9,300 Palestinian detainees and prisoners also remain held in Israeli occupation prisons, including 3,101 administrative detainees, 91 women detainees, 350 children, and 1,419 detainees from the Gaza Strip classified by the occupying authorities as so-called “unlawful combatants.” In addition, 93 detainees whose identities have been established have died in custody during the past three years, alongside dozens of detainees from Gaza whose fate remains unknown due to the crime of enforced disappearance.

The statistics on fatalities, together with the repeated and daily bombardment, confirm that the ceasefire agreement has neither ended the war nor provided effective protection for civilians. This is occurring amid continued security risks, widespread destruction, and the Israeli occupation’s control over approximately 65% of the Gaza Strip, as well as restrictions on the entry of essential materials and equipment required for humanitarian response and the rehabilitation of civilian infrastructure.

Approximately 94% of the population of the Gaza Strip remains in urgent need of shelter, basic assistance, and relief, while around 65% of households are living in tents and temporary shelters that lack minimum standards of protection. More than 2,300 unsafe buildings have also been identified that remain occupied and continue to house tens of thousands of people, posing a direct threat to the lives of civilians.

Hundreds of thousands of Palestinians also continue to live in overcrowded displacement sites vulnerable to flooding and disease. The United Nations has reported that approximately 279,000 people are living in 400 displacement sites that are at risk of flooding or inside unsafe buildings, as the rainy season approaches and response capacity continues to decline due to funding shortages and restrictions on the entry of essential supplies.

The continuation of these conditions after three years of war constitutes an ongoing violation of fundamental human rights, foremost among them the right to life, the right to health, the right to adequate housing, the right to food and water, the right to education, and the right to protection from forced displacement.

Al-Dameer Association for Human Rights emphasizes that the occupying power has defied and failed to comply with the provisional measures issued by the International Court of Justice (ICJ). It has likewise failed to comply with the arrest warrants issued by the International Criminal Court (ICC) against Israeli officials. The absence of accountability, coupled with the complicity of states that provide weapons and political cover, encourages the occupying power to continue perpetrating these crimes. The international community, particularly the States Parties to the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, bears a legal and moral responsibility for its failure to fulfill its obligations to prevent the genocide and hold those responsible accountable.

Accordingly, Al-Dameer Association for Human Rights calls for:

The international community, particularly the United Nations Security Council, the United Nations General Assembly, and States Parties to the Geneva Conventions and the Convention on the Prevention and Punishment of the Crime of Genocide, to assume their legal responsibilities and take immediate and effective measures to ensure the protection of Palestinian civilians and prevent the continuation of genocide.

The immediate and complete cessation of genocide and attacks against civilians, the opening of crossings, and the unrestricted flow of humanitarian assistance and reconstruction materials.

The immediate termination of the occupying power’s control over the so-called “Yellow Areas,” the prevention of any forced displacement, the implementation of the decisions of the International Court of Justice and the International Criminal Court, and the prosecution of perpetrators of violations.

The release and protection of detainees, disclosure of the fate of persons subjected to enforced disappearance, and enabling international bodies to visit and inspect their places of detention.
