122  منظمة وشبكة حقوقية ومجتمع مدني تشيد ب “صدور مذكرات اعتقال نتنياهو وجالانت” وتطالب بملاحقة المشاركين بالتخطيط والمال والسلاح والتنفيذ

تشيد منظمات المجتمع المدني وحقوق الإنسان الموقعة أدناه  بقرار المحكمة الجنائية الدولية بإصدار مذكرات اعتقال بحق رئيس وزراء كيان الاحتلال والفصل العنصري  بنيامين نتنياهو ووزير الحرب السابق يوآف جالانت، وترى في هذا القرار خطوة في الاتجاه الصحيح، طال انتظارها، نحو تفعيل القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني وميثاق روما لمواجهة جرائم الحرب والعدوان التي نفذها  الاحتلال  بحق الشعب الفلسطيني بهدف الإبادة الجماعية والتهجير القسري وإعادة رسم خارطة جديدة في الشرق الأوسط.

إن هذا القرار يعد انتصارا  لمبادئ العدالة الدولية وحقوق الإنسان، ويؤكد على أهمية عدم إفلات مجرمي الحرب من العقاب، ويبشر بإعادة الثقة للمؤسسات القضائية الدولية.

أن إصدار هذه المذكرات يعكس إجماعاً دوليا متزايداً بضرورة محاسبة قادة كيان الاحتلال والفصل العنصري على جرائم الحرب وجرائم ضد الإنسانية وجرائم الإبادة الجماعية، يبعث برسالة واضحة أن الحصانة المطلقة التي تمتع بها قادة الاحتلال لعقود قد انتهت، كما يشيد بمواقف الدول الأعضاء في المحكمة الجنائية الدولية، والتي أبدت التزاما قويا بمبادئ العدالة عبر رفضها السماح لنتنياهو وجالانت بدخول أراضيها، مما يعزز إمكانية وضرورة عزل كيان الاحتلال والفصل العنصري ومقاطعتها وعدم تزويدها بالسلاح تماما كما حصل مع نظام الفصل العنصري في جنوب إفريقيا.

تثمن المنظمات الدور الذي لعبته المنظمات الحقوقية غير الحكومية على الصعيد العالمي، كذلك دور دولة جنوب أفريقيا في هذا المضمار، التي وقفت وما زالت  إلى جانب الحق الفلسطيني منذ أعلن المناضل نلسون مانديلا  أن “حرية جنوب أفريقيا منقوصة طالما لم تنال فلسطين حريتها”.

إننا نأمل أن تبادر جميع دول العالم والمنظمات الدولية الى تعزيز هذا القرار بجملة من المواقف والإجراءات بما فيها حظر تصدير السلاح إلى جيش الاحتلال وفرض عقوبات اقتصادية وإدانة كل أفعاله الاجرامية التي ترتقي إلى جرائم الإبادة الجماعية. كما نشيد بمواقف الممثل الأعلى للسياسة الخارجية والأمنية في الاتحاد الأوروبي جوزيب بوريل الذي اعتبر قرار المحكمة الجنائية الدولية ملزم ويجب تنفيذه من جانب جميع الدول والشركاء في المحكمة.

وتدين المنظمات بشدة الموقف الأمريكي المساند لدولة الاحتلال والفصل العنصري الذي اعترض على قرار المحكمة الجنائية الدولية.

وأخيرا تطالب المحكمة الجنائية الدولية بمساءلة ومقاضاة كل الذين يبقون داعمين بالسلاح والعتاد وممولين لسياسات القتل والإبادة الجماعية والتجويع المنتهج من طرف نتنياهو وغالانت سواء كانوا أفرادا أو رؤساء هيئات سياسية أو مؤسسات اقتصادية داعمة أو رؤساء دول.

Statement

122  Human Rights and Civil Society Organizations and Networks Praise the “Issuance of Arrest Warrants for Netanyahu and Galant” and Demand the Prosecution of Those Involved in Planning, Financing, Weapons and Implementation

 

The undersigned civil society and human rights organizations praise the decision of the International Criminal Court to issue arrest warrants for the Prime Minister of the occupation and apartheid entity, Benjamin Netanyahu, and former Minister of War Yoav Galant, and see this decision as a long-awaited step in the right direction towards activating international human rights law, international humanitarian law, and the Rome Statute to confront the war crimes and aggression committed by the occupation against the Palestinian people with the aim of genocide, forced displacement, and redrawing a new map in the Middle East.

 

This decision is a victory for the principles of international justice and human rights, and emphasizes the importance of not allowing war criminals to escape punishment, and heralds the restoration of confidence in international judicial institutions.

The issuance of these memorandum reflects a growing international consensus on the need to hold the leaders of the occupation and apartheid entity accountable for war crimes, crimes against humanity, and crimes of genocide, and sends a clear message that the absolute immunity enjoyed by the leaders of the occupation for decades has ended. It also commends the positions of the member states of the International Criminal Court,  which have shown a strong commitment to the principles of justice by refusing to allow Netanyahu and Galant to enter their territories, and this enhances the possibility and necessity of isolating the occupation and apartheid entity, boycotting it and not supplying it with weapons, just as happened with the apartheid regime in South Africa. The organizations appreciate the role played by human rights non-governmental organizations on the global level, as well as the role of the State of South Africa in this regard, which has stood and continues to stand by the Palestinian cause since the freedom fighter Nelson Mandela declared that “the freedom of South Africa is incomplete as long as Palestine does not gain its freedom”. We hope that all countries of the world and international organizations will take the initiative to support this decision with a set of positions and measures, including banning the export of weapons to the occupation army, imposing economic sanctions, and condemning all its criminal acts that amount to crimes of genocide. We also commend the positions of the High Representative of the European Union for Foreign Affairs and Security Policy, Josep Borrell, who considered the decision of the International Criminal Court binding and must be implemented by all countries and partners in the court.

 

The organizations strongly condemn the American position supporting the occupying state and apartheid, which objected to the decision of the International Criminal Court.

 

Finally, the organizations demand that the International Criminal Court to question and prosecute all those who continue to support with weapons and equipment and finance the policies of killing, genocide, and starvation pursued by Netanyahu and Galant, whether they are individuals, heads of political bodies, supporting economic institutions, or heads of state.

122 organisations et réseaux de défense des droits de l’Homme et de la société civile saluent la “délivrance de mandats d’arrêt à l’encontre de Netanyahou et de Galant” et exigent que les personnes impliquées dans la planification, le financement, l’armement et la mise en œuvre soient poursuivies en justice

Les organisations de la société civile et de défense des droits humains signataires saluent la décision de la Cour pénale internationale d’émettre des mandats d’arrêt contre le Premier ministre de l’entité d’occupation et d’apartheid, Benjamin Netanyahu, et l’ancien ministre de la Guerre, Yoav Galant. Elles considèrent cette décision comme une avancée majeure et attendue depuis longtemps vers l’application effective du droit international des droits de l’Homme, du droit international humanitaire et du Statut de Rome. Elle constitue un pas crucial pour faire face aux crimes de guerre et aux agressions perpétrés par l’occupation contre le peuple palestinien, dans le cadre d’une stratégie visant à commettre un génocide, provoquer des déplacements forcés et redessiner les frontières au Moyen-Orient.

Cette décision est une victoire pour les principes de la justice internationale et des droits de l’Homme. Elle souligne l’importance de mettre fin à l’impunité des criminels de guerre et affirme que cette décision contribue à restaurer la confiance dans les institutions judiciaires internationales.

La publication de ces mémorandums reflète un consensus international croissant sur la nécessité de tenir les dirigeants de l’entité d’occupation et d’apartheid responsables de crimes de guerre, de crimes contre l’humanité et de crimes de génocide, et envoie un message clair selon lequel l’immunité absolue dont jouissaient les dirigeants de l’occupation depuis des décennies a pris fin. Elle salue également les positions des États membres de la Cour pénale internationale, représentant plus de 124 pays, qui ont démontré un engagement ferme envers les principes de justice en interdisant l’entrée de Netanyahu et Galant sur leur territoire. Cette démarche renforce la nécessité d’isoler le régime d’occupation et d’apartheid, de le boycotter et de cesser tout approvisionnement en armes, à l’image des actions menées autrefois contre le régime d’apartheid en Afrique du Sud. Les instiutions signataires saluent le rôle essentiel joué par les organisations non gouvernementales de défense des droits de l’Homme à l’échelle mondiale, ainsi que le soutien indéfectible de l’État sud-africain à la cause palestinienne. Ce soutien, enraciné dans l’héritage du combattant pour la liberté Nelson Mandela, qui a affirmé que « la liberté de l’Afrique du Sud est incomplète tant que la Palestine n’a pas obtenu la sienne », demeure une source d’inspiration et de solidarité.

Nous appelons tous les pays du monde ainsi que les organisations internationales à soutenir cette décision par une série de positions et de mesures, telles que l’interdiction d’exporter des armes vers l’armée d’occupation, l’imposition de sanctions économiques, et la condamnation des actes criminels assimilables à des crimes de génocide. Nous saluons également la position du Haut Représentant de l’Union européenne pour les affaires étrangères et la politique de sécurité, Josep Borrell, qui a estimé que la décision de la Cour pénale internationale était contraignante et devait être pleinement mise en œuvre par tous les États et partenaires de la Cour.

Les organisations condamnent fermement la position américaine qui soutient l’entité d’occupation et d’apartheid, et qui s’est opposée à la décision de la Cour pénale internationale.

Enfin, les organisations exigent que la Cour pénale internationale interroge et poursuive tous ceux qui, par le biais de l’approvisionnement en armes, d’équipements ou de financements, soutiennent les politiques de violence, de génocide et de famine menées par Netanyahu et Galant, qu’il s’agisse d’individus, de responsables politiques, d’institutions économiques ou de chefs d’État.

Las organizaciones de la sociedad civil y de derechos humanos abajo firmantes elogian la decisión de la Corte Penal Internacional de dictar órdenes de detención contra el Primer Ministro de la entidad de ocupación y apartheid, Benjamin Netanyahu, y el ex Ministro de Guerra Yoav Galant, y consideran esta decisión como un paso largamente esperado en la dirección correcta hacia la activación del derecho internacional de los derechos humanos, el derecho internacional humanitario y el Estatuto de Roma para hacer frente a los crímenes de guerra y la agresión cometidos por la ocupación contra el pueblo palestino con el objetivo de genocidio, desplazamiento forzoso y redibujar un nuevo mapa en Oriente Medio.

 

Esta decisión es una victoria para los principios de la justicia internacional y los derechos humanos, y pone de relieve la importancia de no permitir que los criminales de guerra escapen al castigo, y anuncia el restablecimiento de la confianza en las instituciones judiciales internacionales.

 

La publicación de estos memorandos refleja un consenso internacional cada vez mayor sobre la necesidad de exigir responsabilidades a los dirigentes de la entidad de ocupación y apartheid por crímenes de guerra, crímenes contra la humanidad y crímenes de genocidio, y envía un mensaje claro de que la inmunidad absoluta de que han gozado los dirigentes de la ocupación durante décadas ha llegado a su fin. También elogió las posiciones de los Estados miembros de la Corte Penal Internacional, que han mostrado un firme compromiso con los principios de la justicia al negarse a permitir que Netanyahu y Galant entren en sus territorios, lo que refuerza la posibilidad y la necesidad de aislar a la entidad de ocupación y apartheid, boicotearla y no suministrar armas, al igual que ocurrió con el régimen del apartheid en Sudáfrica. Las organizaciones aprecian el papel desempeñado por las organizaciones no gubernamentales de derechos humanos a nivel mundial, así como el papel del Estado de Sudáfrica a este respecto, que ha estado y sigue estando al lado de la causa palestina desde que el luchador por la libertad Nelson Mandela declaró que “la libertad de Sudáfrica estará incompleta mientras Palestina no consiga su libertad.” Esperamos que todos los países del mundo y las organizaciones internacionales tomen la iniciativa de apoyar esta decisión con un conjunto de posiciones y medidas, incluyendo la prohibición de la exportación de armas al ejército de ocupación, la imposición de sanciones económicas y la condena de todos sus actos criminales que equivalen a crímenes de genocidio. También elogiamos las posiciones del Alto Representante de la Unión Europea para Asuntos Exteriores y Política de Seguridad, Josep Borrell, que consideró que la decisión de la Corte Penal Internacional es vinculante y debe ser aplicada por todos los países y socios de la corte.

 

Las organizaciones condenan enérgicamente la posición estadounidense de apoyo al Estado ocupante y al apartheid, que se opuso a la decisión de la Corte Penal Internacional.

 

Por último, las organizaciones exigen que la Corte Penal Internacional interrogue y procese a todos aquellos que siguen apoyando con armas y material y financiando las políticas de matanza, genocidio y hambruna llevadas a cabo por Netanyahu y Galant, ya sean individuos, jefes de organismos políticos, instituciones económicas de apoyo o jefes de Estado.
